Öz
Konvansiyonel silahlar yayılımı tehdidi ile birlikte kitle imha silahlarının uluslararası güvenlik ve istikrar üzerinde oluşturduğu tehdit 21. Yüzyılda artarak devam etmektedir. Devletlerin daha hızlı şekilde nükleer silahlar inşa etmekte, öngörülemeyen sonuçları olan yeni silah teknolojileri geliştirerek askeri güçlere son on yılda daha fazla kaynak aktarmaktadır. Kimyasal, nükleer, radyolojik silahları içeren ve kitle imha silahları olarak adlandırılan daha büyük bir silah sınıfının bir alt kümesi olan biyolojik silahların kullanımı ciddi bir problemdir ve biyolojik ajanların bir biyoterörist saldırısında kullanılması riski gittikçe artmaktadır. Biyoterörizm 21. yüzyıl için gerçek ve önemli bir tehdit olup devletlerin istikrar, ulusal güvenlik, ekonomik kalkınma ve sürecini gölgelemekte birçok devlet için acil bir ulusal güvenlik durumu olarak kabul edilmektedir. Kitle imha silahlarına karşı mücadelede uygulanan en eski ihracat kontrol rejimi olan COCOM (Coordinating Committee on Multilateral Export Controls/Çok Taraflı İhracat Kontrolleri Koordinasyon Komitesi ) Soğuk Savaş yıllarında en önemli teknoloji transferini kontrol etme mekanizmasıyken Soğuk Savaş döneminin sona ermesiyle birlikte COCOM’a halef bir rejim oluşturma çabaları sonucunda Wassenaar Düzenlemesi oluşturulmuştur. Wassenaar kapsamında işbirliği içinde olan devletlerden risk oluşturan malzeme ve teknolojilerin ihracatının özel bir kontrol rejimi oluşturulması amacıyla da ulusal mevzuatlarının düzenleme kuralları ile uyumlu hale getirilmesi beklenilmiştir. Bölgesel ve uluslararası güvenlik ve istikrara katkıda bulunmak için konvansiyonel silahların ve çift kullanımlı mal/ teknolojilerin transferinde şeffaflığını sağlamak, devletleri daha fazla sorumluluğa teşvik etmek, istikrarsızlaştırıcı birikimleri önlemek amacıyla kurulan Wassenaar Düzenlemesi’ne Türkiye 1996 yılında kurucu üye olmuştur. Türkiye’de 2010 yılında kabul edilen Biyogüvenlik Kanunu biyogüvenlik sisteminin oluşturulması amacıyla atılan önemli bir adım olmakla birlikte sadece Biyogüvenlik Kanunu’nun kabul edilmiş olması yeterli değildir. Zira biyo güvenlik biyo savunma ile yakından bağlantılı olup, savunma amaçlı çıkarılan yönetmeliklerin ve kurulan kamu kurumlarının etkinlik ve işleyişlerinin bir bütün olarak değerlendirilmesi gerekmektedir

WASSENAAR REGULATION AND TURKISH BIOSAFETY LEGISLATION: SUGGESTIONS FOR STABILITY IN THE ADAPTATION PROCESS

With the threat of conventional weapons proliferation, the threat posed by weapons of mass destruction on international security and stability has continued to increase in the 21st century. States have been building nuclear weapons faster, developing new weapon technologies with unpredictable results, and transferring more resources to military forces in the last decade. The use of biological weapons, a subset of a larger class of weapons called weapons of mass destruction, which includes chemical, nuclear, and radiological weapons, is a serious problem and the risk of using biological agents in a bioterrorist attack is increasing. Bioterrorism is a real and significant threat to the 21st century, shadowing the stability, national security, economic development and progress of states and is considered an urgent national security situation for many states.
COCOM (Coordinating Committee on Multilateral Export Controls), the oldest export control regime applied in the fight against weapons of mass destruction, was the most important technology transfer control mechanism during the Cold War years, and with the end of the Cold War period, it became a successor regime to COCOM. The Wassenaar Arrangement was created as a result of Within the scope of Wassenaar, it was expected that the national legislations would be harmonized with the regulation rules in order to establish a special control regime for the export of risky materials and technologies from the cooperating states.
. Turkey became a founding member of the Wassenaar Arrangement in 1996, which was established in order to contribute to regional and international security and stability, to ensure transparency in the transfer of conventional weapons and dual-use goods/technology, to encourage states to be more responsible, and to prevent destabilizing savings. Although the Biosafety Law adopted in Turkey in 2010 is an important step towards the creation of a biosafety system, it is not enough just to have the Biosafety Law passed. Because biosecurity is closely related to biodefense, the effectiveness and functioning of the regulations issued for defense purposes and the established public institutions should be evaluated as a whole.
